Toxic, Hazardous Materials, Firearms, and Weapons Safety

Purpose

To ensure a safe, healthy, and compliant environment by preventing children’s access to toxic substances, hazardous materials, firearms, weapons, and impairing substances while on the premises or in vehicles used by the childcare facility.

Scope

This SOP applies to:

• All staff, administrators, substitutes, volunteers, contractors, and visitors

• All classrooms, common areas, storage areas, outdoor spaces, and vehicles used by the childcare facility

Responsibility

• Director/Administrator: Overall enforcement, monitoring, and compliance

• All Staff: Daily adherence, reporting hazards, and maintaining child safety

• Maintenance/Custodial Staff: Proper storage, labeling, and handling of hazardous materials

Procedures

A. Child-Accessible Area Safety

1. All areas and surfaces accessible to children must be free from toxic substances, bio-contaminants, and hazardous materials at all times.

2. The following items are strictly prohibited in child-accessible areas:

   • Power tools

   • Plastic bags

   • Matches

   • Candles

   • Lighters

   • Any equipment or material that poses a choking, fire, chemical, or injury risk

3. Staff must conduct daily visual safety checks of classrooms and shared spaces before children arrive and throughout the day.

4. Any unsafe item discovered must be removed immediately and reported to administration.

B. Storage and Handling of Hazardous Materials

1. All potentially harmful items must be:

   • Clearly labeled

   • Used only according to manufacturer’s instructions

2. Hazardous items include, but are not limited to:

   • Cleaning supplies

   • Flammable products

   • Poisonous or toxic substances

   • Chemicals and maintenance materials

   • Knives, sharp tools, or cutting instruments

3. These items must be:

   • Stored in a locked cabinet or room, or

   • Kept completely inaccessible and out of children’s reach at all times

4. Keys or access codes to locked storage areas must be controlled by authorized staff only.

5. Under no circumstances may hazardous materials be left unattended in areas accessible to children.

C. Firearms and Weapons Prohibition

1. Firearms and weapons, as defined in Section 790.001, Florida Statutes, are strictly prohibited:

   • Inside any building

   • On any person located on the premises

2. This prohibition applies to:

   • Staff

   • Parents/guardians

   • Visitors

   • Contractors

3. Exception: Federal, state, or local law enforcement officers acting in an official capacity.

4. Any known or suspected violation must be reported immediately to administration and handled according to emergency and legal protocols.

D. Prohibited Substances (Drugs and Alcohol)

1. The following are not permitted on the premises or in facility vehicles:

   • Narcotics

   • Alcohol

   • Impairing drugs

   • Drug paraphernalia

2. This applies to:

   • All buildings

   • Outdoor areas

   • Vehicles used to transport children

3. Staff must not report to work under the influence of any impairing substance.

4. Any suspected violation must be reported immediately to administration and handled according to disciplinary and reporting procedures.

Monitoring and Compliance

• Routine inspections will be conducted by administration.

• Non-compliance may result in:

  • Corrective action

  • Disciplinary measures

  • Termination

  • Reporting to licensing authorities, when required

Training Requirement

• All staff must receive training on this SOP:

  • Upon hire

  • Annually thereafter

  • Whenever updates are made to the policy

Documentation

• Safety checks, incidents, and corrective actions must be documented and retained according to recordkeeping requirements.
