Child Abuse & Neglect Reporting

Purpose:
To ensure that all staff at Young Innovators Academies comply with Florida law regarding the identification and mandatory reporting of suspected child abuse, neglect, or abandonment.

Policy Statement

All childcare personnel at Young Innovators Academies are mandated reporters under Florida law (s. 39.201, F.S.). Any suspicion of abuse, neglect, or abandonment must be reported immediately to the Florida Abuse Hotline. Failure to report is a violation of state law and may result in legal consequences and disciplinary action.

Definitions:

Child Abuse or Neglect – As defined by s. 39.201, F.S., is “harm or threatened harm” to a child’s physical or mental health or welfare by acts or omissions of:

A parent
An adult household member
Any person responsible for the child’s welfare
OR by any person (for reporting purposes)

Types of Abuse and Indicators:

Physical Abuse or Neglect:
- Indicators: Unexplained bruises, burns, welts, frequent injuries, poor hygiene, hunger, or lack of supervision.
Emotional Abuse or Neglect:
- Indicators: Excessive withdrawal, aggression, depression, failure to thrive, developmental delays.
Sexual Abuse:
- Indicators: Sudden changes in behavior, excessive crying, fear of certain people, inappropriate sexual knowledge or behavior, physical signs in genital areas.

Staff Responsibilities:

Remain vigilant and alert to all physical and behavioral signs of possible abuse or neglect.
Immediately report suspicions to the Florida Abuse Hotline.
Do not investigate, confront the parent/guardian, or attempt to validate the suspicion.
Notify the Center Director immediately after making the report (not before).
Document the observation that led to suspicion in detail, including date, time, child’s behavior, visible signs, and any statements made by the child.

Legal Requirements:

Reporting is mandatory by law under s. 39.201, F.S.
Failure to report is considered a first-degree misdemeanor.
Reporting is the individual responsibility of the staff member who suspects abuse.
There is no requirement for proof — suspicion is sufficient.

Confidentiality and Protection:

Reporters’ identities are kept confidential.
Florida law provides immunity from liability for those who report in good faith.
Retaliation against reporters is strictly prohibited.

Training:

All staff must receive annual training on recognizing and reporting child abuse and neglect.
Staff must sign an acknowledgment form confirming their understanding of their duties as mandated reporters.
